Introduction

These terms and conditions ("Terms") govern the use of Firewood's website and the purchase of firewood export services. By accessing this website or placing an order, you agree to be bound by these Terms.

Definitions

  • "Firewood", "we", "us", "our": Refers to Firewood, the firewood export company.
  • "Buyer", "you", "your": Refers to the party purchasing firewood export services.
  • "Order": A confirmed purchase of firewood products and export services.
  • "Contract": The written agreement between Firewood and the Buyer for a specific order.

Orders & Contracts

All orders are subject to written confirmation and a formal contract. Quotations are valid for the period specified (typically 30 days) and are subject to change without notice after expiry. A binding contract is formed only upon written confirmation by Firewood and receipt of any required deposit or payment.

Pricing & Payment

Prices are quoted in EUR or USD as specified. Prices are based on current market conditions, exchange rates, and incoterms selected. We reserve the right to adjust prices if market conditions change significantly before order confirmation. Payment terms are specified in each contract and typically include:

  • Deposit upon order confirmation (typically 30-50%)
  • Balance before shipment or upon delivery, as agreed
  • Payment by bank transfer or other agreed method

Delivery & Incoterms

Delivery terms are specified in each contract using standard Incoterms (EXW, FCA, DAP, etc.). Lead times are estimates and not guaranteed, though we make every effort to meet agreed timelines. Delays due to force majeure, customs, or circumstances beyond our control do not constitute breach of contract.

Risk of loss or damage transfers to the Buyer according to the selected incoterm. The Buyer is responsible for import clearance, duties, and taxes unless otherwise specified in the contract.

Quality & Specifications

We warrant that products meet the specifications stated in the contract, including moisture content, species, and packaging. Quality control documentation is provided with each shipment. Claims for non-conformity must be notified in writing within 7 days of delivery, with supporting evidence.

Our liability is limited to replacement of non-conforming products or refund of the purchase price, at our option. We are not liable for indirect, consequential, or incidental damages.

Documentation

We provide standard export documentation including phytosanitary certificates, commercial invoices, packing lists, and certificates of origin. Documentation is prepared in accordance with standard export practices. The Buyer is responsible for ensuring documentation meets specific import requirements of the destination country.

Force Majeure

We are not liable for delays or failures to perform due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, government actions, transport disruptions, supplier failures, or changes in export/import regulations.

Cancellation & Returns

Orders may be cancelled only by mutual agreement or as specified in the contract. Cancellation fees may apply. Returns are not accepted except for non-conforming products as specified above. Custom orders are not returnable.

Intellectual Property

All content on this website, including text, images, logos, and design, is the property of Firewood and protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.

Limitation of Liability

To the maximum extent permitted by law, Firewood's total liability for any claim arising from these Terms or our services shall not exceed the total amount paid by the Buyer for the specific order giving rise to the claim.

Governing Law

These Terms are governed by the laws of Ukraine. Any disputes shall be resolved through good faith negotiation, and if necessary, through the courts of Ukraine or as otherwise agreed in the contract.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page. Continued use of our services after changes constitutes acceptance of the modified Terms. Specific contracts supersede these general Terms.
